My BALTA terms of use
1. Terms Used in the Rules
- 1.1. Rules – these terms of use for Mana BALTA approved by AAS “BALTA”.
- 1.2. Mana BALTA – the connection and service management system created by AAS “BALTA” on the AAS “BALTA” website, providing access to the services offered by AAS “BALTA” on the website.
- 1.3. User – a person who uses Mana BALTA in accordance with these Rules.
- 1.4. Access Parameters – a unique combination of access parameters chosen by the User, ensuring identification for the use of Mana BALTA.
- 1.5. Cooperation Partner – SIA “ZZ Dats”. The information security management system “eDrošība” of SIA “ZZ Dats” was certified in June 2010 as compliant with the international standard “ISO/IEC 27001:2005 Information technology - Security techniques - Information security management systems - Requirements”.
2. General Provisions- 2.1. The Rules determine the procedure by which AAS “BALTA” provides the User with access to the services offered by AAS “BALTA” on the internet.
- 2.2. The provision of the service begins after the User’s identification in accordance with the procedure specified in clause 3.1 of the Rules, by the User activating the service available on the AAS “BALTA” website, mobile application, or link available to the User.
- 2.3. Mana BALTA is available online 24/7. Temporary interruptions in the operation of the Mana BALTA system are permissible, related to the maintenance, servicing, and improvement of Mana BALTA and related systems, as well as due to the actions of internet service providers.
3. Access Parameters and User Identification- 3.1. The User’s identification is carried out using the eDrošība service provided by the Cooperation Partner. The description of the eDrošība process can be found on the website www.epakalpojumi.lv.
- 3.2. The User’s identification is carried out in accordance with the identification procedure established by the Cooperation Partner, which is confidential.
- 3.3. The User’s identification in the AAS “BALTA” mobile application is carried out in accordance with the procedure specified in clause 3.1 of these Rules, with the possibility for the User to create a 4-digit security code, ensuring further simplified identification in the AAS “BALTA” mobile application.
- 3.4. If the User has not used the simplified identification specified in clause 3.4 of these Rules for more than 360 days, the User must re-identify in accordance with the procedure specified in clause 3.1 of these Rules.
- 3.5. If the User has identified in the AAS “BALTA” mobile application, the session in My Insurance will be available for another 3 minutes after closing the AAS “BALTA” mobile application in the background mode, therefore it is recommended to log out of Mana BALTA after use.
- 3.6. The User must ensure the security of their mobile device to prevent third parties from accessing the User’s personal data in Mana BALTA. The User is obliged not to leave the AAS “BALTA” application on (without logging out of Mana BALTA after use) and/or must not send or leave security codes or other Access Parameters in places accessible to other persons. If the User suspects that the security code of the AAS “BALTA” mobile application is known to other persons, the User must immediately change the security code of the AAS “BALTA” mobile application or reload the AAS “BALTA” mobile application, re-identifying in accordance with the procedure specified in clauses 3.1 and 3.3 of these Rules.
4. User Obligations and Responsibilities- 4.1. The User undertakes to:
- 4.1.1. comply with the Rules and ensure that persons authorized by the User to use Mana BALTA on behalf of the User are familiar with and comply with the Rules;
- 4.1.2. keep confidential and not disclose to third parties confidential information about the Access Parameters used to connect to Mana BALTA, and prevent third parties from learning it. The User acknowledges and understands that third parties who have learned confidential information about the Access Parameters can access Mana BALTA and perform actions on behalf of the User, including establishing relevant obligations. All actions carried out in My Insurance using the correct User Access Parameters are considered to be performed by the User and binding on the User;
- 4.1.3. if confidential information about the Access Parameters has become known to a third party, the User must immediately inform AAS “BALTA”;
- 4.1.4. when accessing Mana BALTA on a computer, ensure that the computer meets the minimum requirements for receiving Mana BALTA. For certain services, the User will be prompted to confirm the use of AAS “BALTA” cookies and/or JavaScript, as refusal may result in the selected service being unavailable. More information about the use of AAS “BALTA” cookies can be found on the website www.balta.lv in the AAS BALTA personal data processing notice to clients.
- 4.1.5. not use third-party connection parameters, except in cases where these persons have authorized the User to use this data.
- 4.2. The User is responsible for all actions performed using the Access Parameters assigned to them, as well as any other AAS “BALTA” identification tools.
5. AAS “BALTA” Obligations, Rights, and Responsibilities- 5.1. AAS “BALTA” undertakes to:
- 5.1.1. identify the User in accordance with the Rules;
- 5.1.2. provide Mana BALTA services to the User in accordance with the Rules; 5.1.3. ensure the confidentiality of information about the User. Confidential information may be disclosed to third parties only in cases provided for by the laws and regulations in force in the Republic of Latvia or with the User’s permission.
- 5.2. AAS “BALTA” has the right to collect and process the obtained information about personal data, the IP address assigned to the User’s device (computer), as well as other information transmitted, sent, or transferred to AAS “BALTA” within the framework of Mana BALTA, with the aim of providing the User with Mana BALTA;
- 5.3. AAS “BALTA” has the right, but not the obligation, to block the User’s access to Mana BALTA in cases where there are suspicions related to unauthorized access to Mana BALTA, including suspicions that the Access Parameters have become or may become known to a third party, or Mana BALTA is being used illegally, and in other cases at the discretion of AAS “BALTA” to ensure security and integrity, as well as to avoid possible losses to AAS “BALTA” or other AAS “BALTA” clients.
- 5.4. AAS “BALTA” is not responsible for and does not compensate the User for existing or potential losses:
- 5.4.1. for damages or disruptions in the operation of Mana BALTA if the cause is damage, malfunctions in the User’s equipment, the User’s email configuration or load, the use of inappropriate or unlicensed equipment or software, interruptions in the supply of electricity and/or internet service, or the User’s computer not meeting the conditions for using Mana BALTA;
- 5.4.2. if the User has used Mana BALTA without complying with these Rules;
- 5.4.3. if Mana BALTA is used illegally;
- 5.4.4. if the operation of Mana BALTA is disrupted, suspended, or terminated for any reason;
- 5.4.5. during the improvement or maintenance of Mana BALTA.
6. Other Provisions- 6.1. The Rules come into force with the commencement of the use of Mana BALTA. The use of Mana BALTA is considered confirmation that the User has read these Rules, the amendments to the Rules announced by AAS “BALTA”, and other changes regarding the provided services and agrees to them.
- 6.2. AAS “BALTA” has the right, without prior notice to the User, to change the procedure for providing Mana BALTA services, change the amount of services and information available to the User, the payment procedure, the functional and visual solutions of Mana BALTA. AAS “BALTA” is not responsible for losses incurred by the User or that may arise after the mentioned changes.

6.3. The User agrees that, based on the Terms, the User’s orders to AAS “BALTA” are submitted and processed electronically. All requests, applications, submissions, notifications, and other documents confirmed or submitted by the User through Mana BALTA using the User’s Access Parameters are binding on the User and are identical to documents signed by hand within the meaning of the Civil Code.

6.4. All disputes arising in connection with these Terms shall be resolved through mutual negotiations. If disputes cannot be resolved through negotiations, they shall be resolved in accordance with the legislation of the Republic of Latvia.
